NOTICE OF INTENT TO ISSUE SOLE SOURCE AWARD The U.S. Department of Health and Human Services (HHS), Indian Health Service (IHS), Bemidji Area intends to award a Purchase Order on a sole source basis to BioRad Laboratories, for White Earth Health Center, Ogema, MN. The anticipated period of performance will include a twelve (12)-month base period from 06/01/2023 to 05/31/2024 and four (4) option periods up to 05/31/2028.

The sole source action will be issued under the authority of Federal Acquisition Regulation (FAR) 13.501(a) - only one source reasonably available due to Bio-Rad is the only company that can provide the online data management systems; Unity Web Online, Unity Connect and QCNET as they are owned and operated by Bio-Rad Laboratories and only provided with purchase of control material directly through manufacturer. The control data management systems are sold direct only. Purchasing control material from a third party vendor would not provide the online data management systems required under contract. Market research has identified BioRad Laboratories as the only vendor capable of providing the required interface services for IHS. It is anticipated that the Government will award a Firm Fixed-Price (FFP) Purchase Order for this requirement. The North American Industry Classification System (NAICS) code is 334516 - Analytical Laboratory Instrument Manufacturing – with a size standard of 1,000. This notice of intent is not a request for competitive quotes. Interested persons may identify their interest and capability to respond to the requirement or submit a quote to Contracting Officer, Jennifer Richardson at jennifer.richardson@ihs.gov. Information received in response to this notice will be considered solely for the purpose of determining whether to conduct a competitive procurement. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. In doing so, interested sources must submit technical capabilities, and other information that demonstrates their ability to meet the Government's needs.
