MMCAP Infuse intends to enter into a license agreement with GS1 US, Inc., for up to five years. The agreement will provide MMCAP Infuse access to the GS1 US Data Hub® Managed Global Location Number (GLN) Subscription Program (hereinafter “Data Hub”). The Data Hub is a platform that creates and manages product identification data, such as UPCs and barcodes, and assists to set up blockchains for tracking and tracing pharmaceuticals. Such data is turned into GLNs to ensure independent dispensers, individual practitioners, and other entities within the pharmaceutical industry are numbered. In turn, this helps to ensure that an entity within the pharmaceutical industry is compliant with the Drug Supply Chain Security Act (DSCSA). To comply with the DSCSA, MMCAP Infuse will need the ability to obtain GS1 GLNs, which the Data Hub will do.

In 2013, the Food and Drug Administration (FDA) enacted the DSCSA. The DSCSA requires the pharmaceutical industry to adopt an electronic, interoperable system to identify and trace certain prescription drugs as they move through the United States’ supply chain. In addition, DSCSA requires the system to be implemented by an entity in the pharmaceutical industry by November of 2023. The pharmaceutical industry came together and agreed on using GS1 standards as the standards for DSCSA compliance, and, accordingly, the FDA and other global regulatory agencies have put out notices that mandate entities in the pharmaceutical supply chain to establish relationships with GS1. This makes the Data Hub the only system that is commercially available to meet the business needs of MMCAP Infuse. In addition, the Data Hub is a proprietary product. A license to access the Data Hub is sold only by GS1 US, Inc. For these reasons, MMCAP Infuse has determined this to be a single source purchase.
