Minnesota Pollution Control Agency (MPCA) intends to enter into an option for a lease agreement with Connexus Energy. The future lease agreement will allow the MPCA to lease land that it owns and is located at the Anoka-Ramsey closed landfill (hereinafter “the closed landfill”) to Connexus Energy for the purpose of a solar energy generating system pilot project. The MPCA will have up to one year to exercise the option to enter into a lease agreement with Connexus Energy.

Under Laws of Minnesota 2021, 1st Spec. Sess. chapter 4, article 1, section 2, subd. 10, the MPCA was given the authority to take actions and execute agreements to facilitate the beneficial reuse of the closed landfill and, specifically, to install a solar energy generating system as a pilot project at the closed landfill. Such a pilot project is to be owned and operated by a cooperative electric association that has more than 130,000 customers in Minnesota.

After carrying out a search, the MPCA determined that Connexus Energy is the only entity that meets the criteria outlined within the session law noted above. Other entities that the MPCA identified in its search either have fewer than 130,000 customers or are investor-owned. For these reasons, the MPCA has deemed Connexus Energy to be the only entity with which the MPCA can enter into the option to lease, for the future purpose of the solar energy generating system pilot project.
